A woman from Woodbury was killed in a crash with a tow truck stopped on a highway shoulder.
A tow truck responding to a previous crash on the left shoulder of 494 at Hardman in Dakota County was stopped on the shoulder. A Honda CRV hit the right rear of the tow truck. The driver of the Honda, a woman from Woodbury, MN, did not survive.
The accident happened early in the early morning on December 12, 2016.
The South St. Paul Police Department assisted at the scene.
Most people do not know that a driver can be at fault for a crash if he or she is illegally stopped, this includes stopping on a highway shoulder in a manner that puts others at risk. For example, Dave, a truck driver, pulls over and parks on the shoulder, but part of the trailer is on the road just a bit. A pickup drives by hugging the right line, does not see the trailer, hits it, and is severely injured. Dave and the company that has hired him are legally responsible and can be sued for compensation.
Lawsuit Settled in Wrongful Death Case Involving Stopped Vehicle
Attorneys Fred Pritzker and Eric Hageman recently settled a wrongful death lawsuit involving an illegally stopped semi-truck and trailer. The family of a driver who rear ended the semitrailer hired our law firm after the trucking company claimed its driver was not at fault, not even stopped in the road. Fred and Eric studied the evidence, including skid marks and cell phone data, and determined that the truck driver was at fault, in fact, he was on his cell phone talking with his girlfriend at the time of impact.
