Facts Alleged in the Lawsuit
On April 20, 2015, the 3M Bair Hugger was used on our client, referred to hereafter as “Plaintiff” (the legal term for the person suing), during the course of his hip replacement surgery. His hip became so infected that he needed multiple additional surgical procedures to remove the implant and clean the infected area, all within less than six months of the original implant surgery:
- Irrigation and debridement to remove infected tissue:
- Second irrigation and debridement;
- Surgery to remove the implant and have an antibiotic spacer implanted;
- Surgery to remove the antibiotic spacer and implant of a new hip implant device.
Plaintiff continues to suffer substantial damages, including but not limited to impaired mobility, which generally requires Plaintiff to use a cane when walking outside.
The lawsuit alleges the source of the infection was the Bair Hugger.
What is the Bair Hugger?
More than 50,000 Bair Hugger units are currently in use across the country to warm patients during surgery by blowing hot air on a patient’s exposed skin. The product consists of a portable heater/blower connected by a flexible hose to a disposable blanket that is positioned over (or in some cases under) surgical patients.
