This morning a young man from Bovey, Minnesota, was seriously injured in an accident at the intersection of Highway 65 and County Road 58 in Itasca County, east of Grand Rapids and Bovey. He was driving a Dodge W350 pickup when he was in a collision with a Peterbilt semi hauling a dolly-type trailer. The semi-trailer was driven by James Maynard, an Illinois truck driver.
Foggy Driving Conditions
The investigation has just started, and the Minnesota State Patrol is not releasing much information. We do know there was fog and that it was a 2-lane road.
Below are some of the questions that need answers to determine if there is a personal injury claim against the semitrailer driver, trucking company and others:
- Was the semi truck driver driving too fast for the road conditions and weather?
- Was he distracted at the time of the crash?
- How long had the Illinois driver been on the road?
- What was his past driving record?
- Did a defective part in either vehicle cause the accident or contribute to the severity of the injuries?
- Were the vehicles recently serviced?
As an interstate hauler, the semitrailer driver was required to keep a log of his hours under federal law. This law is meant to prevent crash injuries and wrongful death caused by fatigued truck drivers.
This is just one of many regulations enacted and enforced by the Federal Motor Carrier Safety Administration (FMCSA). Filing a lawsuit against a trucking company may be the only way to obtain the driving log and other evidence that could help determine what caused the crash.
