Recent FedEx Head-On Collision
Today, a man from Elk Grove died when a FedEx truck-trailer combination lost control and crashed head on with the pickup truck he was driving. This tragic, wrongful death happened at about 6 a.m. on Interstate 5.
Was Rain a Factor?
The FedEx semi was traveling southbound on I-5 when it lost control, went over the median and crashed head-on with the pickup, which was traveling northbound on I-5.
It was raining at the time of the crash, and the Highway Patrol is looking at that as a factor. The family the man who died should know that they most likely have a claim even if rain was a factor. The reason is that semi-trailer drivers are supposed drive for the circumstances. For example, if it is raining and the only safe speed is lower than the posted maximum, it is negligence if the driver does not drive at the slower speed.
Similar Crash Case Settled
We just settled a case very similar to this one, where a semi-trailer jackknifed on a slippery road and killed a man driving a car. Attorney Eric Hageman found evidence that the driver of the big rig was not driving safely given the road conditions, and the family of the man who died got compensation and justice. This case was not against FedEx.
These cases are based on state wrongful death laws, which were enacted to provide families with recourse when loved ones are wrongfully killed.
Attorney Eric Hageman has experience successfully helping clients sue FedEx for compensation after a crash where a company driver was at fault.
