Yes, depending on the facts of your case. Our lawyers have filed our first lawsuit on behalf of clients sickened in the outbreak of Listeria monocytogenes infections (listeriosis) linked to caramel apples. There is an established connection between eating Merb’s Candies caramel apples and illnesses in Missouri, where 5 people where sickened.
One person sickened in the outbreak in Missouri has died. The health department is saying it was not because of the Listeria infection, but the family may still have a wrongful death claim against Bidart Brothers, the supplier of the apples and Merb’s Candies.
The case patients in Missouri range in age from 25 to 92. Three of them are male, two female. All are from eastern and northeastern Missouri.
Merb’s Candies Caramel Apple Recall
Merb’s Candies issued a recall of Merb’s Candies brand Bionic Apples and Double Dipped Apples because they may be contaminated with Listeria monocytogenes, a deadly bacteria that can cause meningitis (brain infection), sepsis and respiratory failure.
The Bidart Brothers Connection
One of Merb’s apple suppliers for these products was Bidart Brothers. The FDA found 2 strains of Listeria monocytogenes in the Bidart Bros. processing plant that have the same genetic “fingerprint” as the strains that sickened the 5 people in MO and 27 others in 10 other states. This is “smoking gun” evidence linking the Bidart Brothers apples to the outbreak. It can be used in a lawsuit seeking compensation.
Where Were They Sold?
The recalled Bionic Apples and Double Dipped Apples were sold at St. Louis area locations, through local supermarkets (located in the produce section) and through mail orders nationwide. Merb’s Candies St. Louis store is located at 4000 S. Grand Blvd.
