Yesterday, November 3, 2014, Attorney David Szerlag was in Bergen County Superior Court, NJ for the announcement of a historic settlement proposal in the Stryker Rejuvenate and ABG II hip system litigation. The settlement was announced by Superior Court Justice Brian R. Martinotti. The settlement was finalized after a number of mediations were overseen by the Judge as well as retired US Magistrate Judge Diane Welsh. Attorney Szerlag successfully mediated one of the firm’s Stryker cases in front of Judge Welsh earlier in the year. The “bellwether mediations” as they were called played a pivotal role in negotiating this proposed settlement.
Our law firm represents nearly one hundred claimants in the NJ litigation. Claimants who had Stryker Rejuvenate or ABG II hip systems removed by November 3, 2014, have the opportunity to receive settlement money. Stryker Corporation has agreed to pay a $300,000 base amount per removed failed device as well as significant enhanced compensation for those who suffered additional surgeries or other post operative complications. The settlement also provides for those claimants who need revision surgery but are medically unable to undergo the procedure. The settlement is expected to exceed over 1 billion dollars, with payments beginning in the summer of 2015.
The settlement proposal is very comprehensive and detailed. Our law firm will be contacting those clients who qualify for the settlement.
