Two people were critically injured in a crash involving a FedEx semitrailer. A car was stopped on I-40 east of downtown Nashville when the FedEx semi, hauling 2 trailers, hit the car from behind, according to Nashville police. The driver and passenger of the car were taken to Vanderbilt University Medical Center.
“Even when the accident is a rear-end collision, cases involving large trucks and trucking companies are complex and require experience,” said attorney Fred Pritzker, a lawyer licensed to practice in Minnesota.
Preserve and Gather Evidence
There is a limited time to take important steps to preserve and gather evidence. One of these steps is sending a spoliation letter to the company. This letter puts the company on notice that it needs to preserve evidence (including the black box data) relevant to the accident. If the company receives a spoliation letter and destroys evidence, there are legal consequences.
Can FedEx be Sued When Its Driver Caused the Accident?
Yes,but only if there is evidence establishing the FedEx driver caused (at least in part) the accident or contributed in some way to the severity of the injuries, the company could most likely be sued. Trucking companies are legally responsible for accidents caused by their drivers. This is because it is the company’s responsibility to make sure the drivers are competent, well trained and driving legally and cautiously.
