Attorneys Fred Pritzker and David Szerlag recently won over $40 million for clients injured by a medical product. They are now representing dozens of people with Stryker hip implants that were recalled in June of 2012. Stryker Orthopaedics recalled its Rejuvenate and ABG II modular-neck hip stems due to possible fretting and corrosion, which can lead to metalosis (metal poisoning, specifically chromium and cobalt).
Initially, Stryker stated that the recall would affect only about 1 percent of the patients with these hip replacement implants. Now the company has contacted surgeons who performed the hip replacements with Rejuvenate and ABG II modular-neck hip stems recommending that testing be done on all of the patients. From the Stryker website:
Surgeons should consider performing a clinical examination, such as blood work and cross section imaging on all patients who received a Rejuvenate or ABG II modular-neck hip stem regardless of whether a patient is experiencing pain and/or swelling. Repeat follow-up examination, such as blood work and cross section imaging, should be considered even in the presence of normal initial findings.
The company is also asking doctors to send letters to patients about the expanded testing related to that recall. The letters, written by Stryker, urge patients to contact the Stryker Patient Care Line.
Stryker has hired Broadspire Services to help them with the hip implant claims. When patients call the Stryker Patient Care Line, they will be put in contact with Broadspire. Broadspire is working for Stryker, not patients, and may ask patients to sign away legal rights. Patients should not sign anything without contacting an attorney who is handling these cases first.
Broadspire was hired to manage requests for reimbursement of costs relating to the recall of the Rejuvenate and ABG II modular-neck hip stems. These reimbursements do not include amounts for pain and suffering, emotional distress, disability and other damages.
