If you have a DePuy ASR XL Acetabular System hip implant, you need to contact Attorney David Szerlag, our lead attorney for our DePuy hip lawsuits, today. David is urging patients like you to contact him before it is too late to file a lawsuit against Johnson & Johnson (J&J) and DePuy Orthopaedics.
You May Lose Your Right to Sue DePuy and J&J in August 2012
DePuy ASR XL Acetabular Hip Replacement Systems were recalled in August of 2010. In many states the statute of limitations for product liability cases is 2 years, which means you may lose your right to sue DePuy and J&J in August of 2012.
You may have a case number from DePuy after you filed a claim with Broadside, a company that is helping DePuy and J&J with the recall. Filing a claim with Broadside does not protect your legal rights to sue DePuy and J&J for your ASR hip failure because what you filed did not start a lawsuit. To do that you need to contact David or another attorney at our law firm as soon as possible.
Many of our cases involve people who had revision surgery to remove and replace the DePuy ASR hip. David just signed up another case today involving a client who had a DePuy ASR hip put in about 3 years ago and is now scheduled to have revision surgery to remove the defective DePuy hip and replace it with another artificial hip. She had been experiencing severe pain after her initial hip replacement surgery. An x-ray confirmed the need for revision surgery.
DePuy ASR hip implants have been shown to have a very early failure rate, most likely because they are metal-on-metal hips. The DePuy ASR hip consists of two parts: a ball made of highly polished strong metal and a socket, also made of metal. The ball attaches to the top of the thigh bone, or femur; the new socket attaches to the pelvis. The artificial hip is then fastened to existing bone, which is supposed to eventually grow into the holes in the joint surface to secure them.
What research has shown is that when the metal ball and socket rub against each other, tiny particles of metal (chromium and cobalt) are released into the bloodstream. This can cause chromium and cobalt poisoning, which can damage the bone and tissue around the DePuy hip. Contact our law firm about a hip revision surgery lawsuit.
