EXACTECH Knee, Hip and Ankle Joint Implant Recall Lawsuit

Why have EXACTECH replacement joints been recalled?

Exactech Replacement Joints

Exactech knee, hip and Ankle replacement implants have been wearing out and failing at a much faster rate than expected. The plastic used to cushion the replacement joint starts to oxidize or break down if exposed to oxygen before being implanted in a patient. The packaging used to store these Exactech implants was supposed to protect them from oxygen exposure during shipment and storage. Unfortunately, the packaging Exactech used was defective and did not prevent oxygen from damaging them. This damage made Exactech artificial joints more prone to wearing out, loosening, and causing pain, muscle and nerve damage. This also significantly increases the likelihood that the joint will break at some point after being implanted into the patient.

These types of joint implant failures often require a second surgery (called a revision) to remove and replace the defective joint with a new implant. A second surgery comes with all the dangers of the initial sugary, as well as an increased likelihood of complications and the need to go through the post-surgical rehabilitation process again.

I received a notice from EXACTECH asking me to contact them. Should I talk to an attorney first?

Yes, you should consult with an attorney before signing any documents sent to you by Exactech or by Broadspire. Broadspire has been hired by Exactech to help them with their claims process. Exactech has been telling some patients that they will cover out-of-pocket medical expenses, but agreeing to any kind of compensation from either Exactech or Broadspire may impact your legal rights and ability to make a claim for damages. Even looking up your serial number on the Exactech website may impact your legal rights going forward. You can contact our defective medical device recall attorneys for a 100% free, no obligation, consultation on your case. If you have already signed documents with Exactech or Broadspire, you can definitely still contact us to discuss what your legal options would be.
