The Facts of the Bicycle Wrongful Death Lawsuit
A 53-year old bicyclist, the mother of two and a loving wife, was riding in a bike lane in downtown Minneapolis. At the same time, a semi truck was turning right. The back tires of the truck trailer ran over the bicyclist, killing her. The truck driver told police investigators that he did not see her. The police concluded that the bicyclist should have seen the truck and that the accident was caused, at least in part, by her inability to remove her feet from her new “clipless” bike pedals.
Evidence against the Company Truck Driver
The Pritzker Hageman bicycle accident legal team took the case, even though the police report stated that the bicyclist was at fault. They obtained the truck driver’s logbooks and found numerous falsifications, putting the truck driver’s testimony in question. On top of this, they also found evidence that the truck driver had violated the law and should not have been driving at the time of the accident. Furthermore, when our lawyers deposed the truck driver, he admitted that he did not monitor his right outside mirrors during the fatal turn. Added to this was his admission that he thought he was pulling a 48-foot trailer, when he was actually pulling a 53-foot trailer. This difference in length would have made the turn much wider.
